In the name of God, Amen. I, Roger Benetheton, chaplain of Colmworth, in the county of Bedford, diocese of Lincoln, being whole in mind, do make my will on the last day of the month February, in the year of our Lord 1438 [27 Feb. 1439] in this wise.
Firstly, I bequeath my soul to God, the Blessed Mary, and All Saints, and my body to be buried in the Ceme- tery of St. Denys of Colmworth, next to my father. I will that Richard Bochere, of Rushden, have all lands and tenements which I hold, or by any means might hold in the vill of Higham Ferrars. I bequeath to the Rector of Colmworth aforesaid xx d. April 2, 1439, on the Court Rolls of Higham Ferrers, and still preserved in Higham Ferrers Town Hall. — John Benetheton, of Wol- laston, a neighbouring village, was Vicar of Higham Ferrers from 30 January, 1387-8 to 1404.

DEEDS RELATING TO ELSTOW.

[Prefatory Note. — This collection of deeds, which is in the possession of Mr. Page-Turner, should be of great interest to the historian of Elstow. It is somewhat unusual in the number preserved for a single property, and in the period of more than a century which it covers.
To those unacquainted with the conveyances of the period, one or two points perhaps require a word of ex- planation. One of these is the method of defining the arable land which was to be conveyed by the deed. Since such land was held, as a rule, in strips of a rood, a half acre, or an acre, scattered over the Open Fields, and not in closes or hedged fields, each strip is defined by the ownership of the strips north and south (or east and west) of it, and by the name of the field, road, or other recognis- able land on which it ' abutted ' at one end of the furrows. Another point is the often recurring phrase, ' to be holden of the chief lord of the fee by the services due and of right accustomed,' or similar words. This is a reminis- cence of a much older social system. In early times the lord of a manor held his land from such a tenant-in-chief of the Crown. as Beauchamp of Bedford, on condition that he rendered ' Knight Service.' (See B.H.R.S. articles on this subject). But after that actual service in the field had been commuted for a money payment or scutage,

when the lord of the manor parted with some of his land, the land was sold burdened with its proportional share of this payment or other service, due to the chief lord, and termed forinsic service ; to such service the phrase refers.
Another interesting echo of earlier times, a relic of villanage, is seen in No. xvii ; by this deed a work-rent is still exacted, — a day's labour in harvest time to be done by an able-bodied man, finding his own food.
The Bunyans mentioned in Nos. xliii, xliv, 1, li, liii, are Thomas Bunyan, described as ' brazier,' and as ' petty chapman,' and Anne his second wife, widow of John Bid- kin of Elstow, the grandfather and step-grandmother of the famous John Bunyan.
There is still room for discussion as to the proper medieval spelling of Elstow, in which the evidence of these deeds is not without weight, (i) Domesday Book undoubtedly gives the name as Elnestou (D.B. Facsimile, p. xvii., col. i.) ; but it is admitted that the Norman scribes who took down from oral information barbarous and un- familiar Saxon names, and then copied their notes into D.B., frequently blundered over place-names; their evidence therefore, though weighty, is not finally conclu- sive, (ii.) In reading documents of the xiith to the xviith century, a constant difficulty is met in deciding whether a certain letter is intended to be n or u ; most scribes merely made two ' minim ' strokes, taking for granted that the reader knew the name, and could be in no doubt between the two letters. Starting with the Domesday form, the transcribers of the Record Commission, followed by prac- tically all later transcribers, have taken the two minims to represent n, and have printed the medieval name as Elne- stowe or Alnestowe, though it can as easily be read Elue- stowe or Aluestowe. [The initials A and E had nearly same sound, coming from Anglo-Saxon JE]. (iii.) With the usual human desire to find explanations for names, grew up from the supposed form Elnestowe a legend

that the Abbey of Elstow had been dedicated to St. Helen, and that the place name meant Helen's Stow. The Abbey was, however, undoubtedly dedicated to St. Mary the Virgin, but the question is complicated by the fact that there actually was a chapel dedicated to St. Helen in the churchyard of Elstow (V.C.H., Beds., i, 354), as early as the xivth century. The late Professor Skeat pointed out (Place Names of Bedfordshire : Publ. Camb. Antiq. Soc, xlii, 45) that the genitive case could never be Elnes, Alnes, or Aunes at an early date, and we may dismiss any prejudice in favour of the form Elnestowe on the score of the Saint, (iv.) We now come to the evidence of these deeds. Except as an initial, the letter v is rarely written in medieval deeds, and its sound is represented by u before a vowel. But when, in the hand commonly used for such deeds, the letter v came to be written in the middle of a word at a period embraced by the later deeds of this collection (1589 and onwards), we seem at once to get the form Elvestowe. It is not likely that the sound of the name changed suddenly from Elnestowe to Elvestowe, so it seems probable that the real medieval form was Elue- stowe or Aluestowe, not Elnestowe or Alnestowe, which as a matter of fact would more likely have been shortened to Enstow.
Professor Skeat in his studies of county place-names generally accepted the transcriptions of the Record Com- mission and Rolls Office without criticism; he started, therefore, with the assumption that Elnestowe was the medieval form, from which he deduced a hypothetical iElfnothes-stow. I am not enough of an Anglo-Saxon scholar to dare to offer an alternative explanation, but it is easy to see that less strained Anglo-Saxon derivations than this are possible. The matter is still open for fur- ther dispute, but with the concurrence of Mr. Page- Turner the form Eluestowe has been adopted in this volume. — Editor.]

William Jurdari of Eluestowe, gent., & William Jurdan of same, yeoman, for divers considerations sell to Robert Thornton of Bedford, draper, 4 acres of land lying & being in Eluestowe, Of which 4 acres one acre lies in 2 parcels in Westmead field, lying above the cultivation called Westmead furlong ; one half acre between the land lately in the tenure of George Wauton, gen., on the west & the land of William Watson called Sextens land on the east, abutting on the way leading towards Ampthill, on the north ; another half acre lying above that cultivation between the land late in the tenure of Thomas Rew on the west & the land of

1559 June 10. — Indenture between John Catell of Luton husbandman, brother of William Catlyn, late of Eluestowe, one of the executors of the last will and testa- ment of the said W.C. ; and Edmund Charlton of Bigleswade yeoman brother-in-law of the said W.C, another executor of the said will of the one part : and John Jordan of Bedford husbandman of the other part. The aforesaid executors according to the authority to them given by act of parliament of 30 Hen. viii. for the sum of £13 sell to John Jordan all those 13 acres of land in Eluestowe which the aforesaid W.C. late bought of Richard Jordan his brother-in-law lying particularly & sunderly divided in Eluestowe to the use of the said J. J. his heirs and assigns, &c, &c.

1564 May 14. — Know all men present and to come that we Thomas Wake of Eluestowe in the count v of Bed- ford butcher and Elizabeth my wife for the sum of 16s. . . . paid by one George Wawton of Eluestowe . . . gent, have . . . sold ... to the same George Wawton one acre of arable land ... in the Field of Eluestowe above the furlong called lyttel marshe alias knolforlong next the land called lyttel marshe leye late of the dissolved monastery of Elue- stowe lately in the tenure of Henry Ballard on the west side and the land late of the dissolved Chantry of Eluestowe aforesaid on the east side and on the north head abutts to- wards Cokalyns crosse wey which said acre of land I . . . Thomas Wake lately held . . . for the benefit and use of me the aforesaid Thomas Wake my heirs and assigns by the gift and concession of a charter of confirmation of William Edwardes of Wilshamsted in the said county of Bedford husbandman as by a certain charter of feoffment of the said William Edwards thence to me drawn up dated at Elue- stowe aforesaid 21 December 2 of Elizabeth [1559] as more plainly . . . appears To have and to hold the afore- said acre of arable land with the appurtenances to the same George Wawton his heirs and assigns for ever for the benefit and use of the same George Wawton his heirs and assigns holding by the rent of 2d. a year and the service of the chief Lord of that fee due and of right accus- tomed And I truly the aforesaid Thomas Wake and my heirs by these presents warrant and defend for ever against all people to the aforesaid George Wawton his heirs and assigns for the use of the said George Walton

1577-8 Jan. 3. — To all the faithful in Christ, &c. Henry Cartwright of Bedford gent, in pursuance of a cer- tain agreement made between him the said H. C. of the one part and John Thodye of Renhold husbandman of the other part of even date herewith sells to the said J. T. all that his messuage &c. in Eluestowe lately in the tenure of one John Graves and lately in the tenure of one William Collyns of Eluestowe abutting on the west on a small venell formerly called Goldington lane and on the south thence upon a road leading towards Kempston and also certain other lands in Eluestowe Cotes Kempston Wilshampsteed and Car- dington and also 9 acres of arable land in the parishes and feelds of Eluestowe Kempston and Hardwick which he lately held by a certain charter of confirmation from one George Waddoppe of Eluestow & Elizabeth his wife dated 10 Jan. 1576-7 and also 7 roods of arable land in the fields of Eluestowe which he lately held by a certain charter of confirmation from Robert Emerson of Eluestowe dated 20 June 1566 holding in chief of the lord of that fee by ser- vice thence due & of right accustomed.

1583 Sept. 9. — To all true Christian people to whom these present shall come to be seen read heard or under- stood John Kendall of Eluestowe plumber sendeth greeting.
Whereas one William Walton late of Eluestowe gent, by indenture of lease dated 7 May 1578 demised unto the said John Kendall one messuage in Eluestowe late William Benson's, together with the garden & croft thereto adjoining, and also half an acre of arable land ad- joining the said croft, except and always reserved unto one William Fletcher of Eluestowe one chamber under the stairs during the term of his natural life to have and to hold to the said J. K. for the term of 15 years yielding and paying to the said W. W. 14s. per ann. at Lady Day and Michaelmas so long as the said Fletcher shall live and after his death the yearly rent of 15s. Now know ye that I the said J. K. in consideration of the sum of 45s. 8d. to me paid by William Radwell do hereby sell to him all my estate and title and term of years yet to come, &c, &c.

1589 May 3. — To all the faithful in Christ, &c. Thomas Stratton of Trumpington in co. Cambs. husband- man and John Stratton of Baldock co. Herts, husbandman

Whereas Thomas Stratton formerly of Houghton Conquest husbandman deceased, father of the said Thomas and John, by his last will and testament dated 30 Sept. 1564 inter alia gave & bequeathed to Joane his wife all his free lands for life and that after the decease of the said Joanne all the aforesaid lands remained to us the aforesaid Thomas and John their heirs and assigns for ever (which said Joanne is defunct). Be it known that we the aforesaid Thomas and John Stratton in consideration of the sum of ^16 10s. od. to us paid by Thomas Cran- fielde of Elvestowe alias Elstowe husbandman by this our deed sell to him one half acre of arable land formerly belonging to Thomas Stratton our father lying in the field of Elvestowe above Longeland, between the land of the Lady Queen on the one part stretching from the highway towards the stream called Elstowe brook. To have and to hold the said half acre of land to the aforesaid Cran- field for ever in chief of the lord of that fee for the service thence due and of right accustomed.

Frances Storey of Bedford widow and William Terrell of Bedford laborer in consideration of the sum of £ 50 3s. 4d. to us paid by Anthony Mansfield of Eluestowe yeoman sell to him one acre of arable land in the fields of Eluestowe in Sharpe feild of which one rood lies above Wyndmyll hill furlong between the land of the lady Queen now or lately in the tenure of Frances Spycer on the one side another rood thereof lying above knole furlong between the land of the lady Queen on the North side and the land called the Towne land on the south and abutts on the west upon Port Waye and one half acre lying near Kempstone Crosse between the land of the lady Queen on the one side and abutting towards the east above Rydge Waye which said acre is in the tenure of one Wliliam Dove of Elue- stowe and was formerly parcel of land of Robert Thorn- ton of Bedford deceased father of the said Frances Storey to have and to hold for ever in chief of the lord of that fee by the service thence due and of right accustomed.

The said Robert sells to Thomas Cooper all that messuage called the Chanterie or Chanterie House in the parish of Elestoe with all the buildings &c. thereto be- longing and also 7 acres of meadow in the Common Meade of Elestoe and Kempston sometime belonging to the Chanterie of Elestoe And likewise all that close called Meade Close in the parish of Elestoe and likewise all those parcells of arable land set out in a terrier hereto annexed all which premises the said Robert late purchased, inter alia, from the said Thomas and Richard Conquest of Houghton Conquest Esq. by Indenture dated 17 Nov.

1609 Dec. 26. — Indenture between Roger Helder alias Barker of Ellstowe yeoman, and John Waldocke of the same labourer. The said Roger for divers good causes and considerations demises to the said John sufficient in- gate and outgate with free ingress egress and regress at all times for the said John to pass with horses carts and car- riages &c. in out by and through the grounds and gates of the said Roger to the yard and grounds of the said John in Ellstowe lately purchased of the said Roger and next ad- joining to the said ground of the said Roger where the pas- sage way is and must be for the term of 60 years yielding and paying therefor yearly in harvest time during the said term one good and sufficient day's work of an " hable " and sufficient man who shall find his own diet and main- tenance. V. in con- sideration of the sum of 5s. and also in execution and per- formance of the trust reposed in Thomas Vinson of Elue- stowe yeoman deceased father of the said T. V. by Sir Thomas Hillersdon knight deceased father of the said T. H. and also according to the direction of the said Sir Thomas Hillersdon expressed by his last will and testa- ment dated 3 June 1623 hath sold to the said T. H. all that tenement with the appurtenances in Eluestowe and one close of pasture adjoining containing about 2 acres now or late in the tenure of William Hoddle. And also all that cottage adjoining the said tenement and a close adjoining containing about 1^ acres now or late in the tenure of Thomas Jacques. 1628 November 2. — John Rodwell of Ellstow hus- bandman. To loving wife Millicent goods and household stuff now in the house which she brought with her, also one red bullock and one stock of bees ; to son William R. a tenement or cottage situate in Ellstow called Lambs Gate with all yards, gardens, orchards, &c, also one acre of arable land in Westbrook field ; to daughter Hester R. the cottage or tenement lately purchased of John Crowley with all yards, gardens and orchards except 1^- acres of arable land. To daughter Jone Radwell 3-^ acres of arable land lying dispersedly in the common fields of Ell- stow, 2 acres of it purchased of Edward Dimocke and i-J acres purchased of John Crowley, also one joined bed- stead and " bowster," one covering, one old blanket, one pillow, one pair of new " flexen " sheets, one pillowbere, one faircloth, two napkins, one tablecloth, one table and frame standing in the " perler," one form to it, a little round table, a little " cubhard," one coffer, one box, one joint " stowle," one pewter platter, one " sawcer," one fruit dish, one bevill, one tub, one lining wheel, one kettle, one jug, one wooden bowl, one pair of andirons, a brass pot, & a salting trough. To son William a boarded bedstead, two pillows, a blanket, a mattress, a pair of sheets, the long table in the hall and form to it, two coffers, a chair, a joint stool, a bevill, a tub, a spit, a fruit dish, a kettle, and the biggest leather bottle. To daughter Hester a boarded bedstead, a bolster, a blanket, two pillows, a coffer, a box, a table, a bevil, a tub, a skyming out bowl, a linen wheel, a table cloth and two napkins with contingent remainder over, and should all his children die then to descend to the children of Edward and William Rodwell his brothers in equal shares. Residue to son William and appoints him sole executor.

Memorandum. — ' It is my mind and will that my brother Edward Rodwell shall pay himself for all his pains & labour with reason and that my daughter Jone shall have the profit and rent of the tenement before given to Hester for four vears, viz : — from the time she the said Hester shall be of the age of 17 till she come to the age of 21.

D. and E. W. & Katherine his wife in consideration of the sum of £ 1 28 covenant that they will before the feast of St. John Baptist next ensueing by fine in due form of law to be levied recognize and ac- knowledge All that messuage or tenement in Elvestowe near the bridge and brook there adjoining to Spinny Lane, also a close or pightel thereunto adjoining which said premises are now in the tenure of John Shelley, And also a close of pasture called Chauntery Cow Close in Elve- stowe containing about 6 or 7 acres. S. 4^- acres of j arable land lying in the common fields of Elvestoe j whereof 7 lands containing about 3 acres and 3 roods lie j together in Westbrook held on Long Land furlong between the land of the said F. S. called Chantry Lands' on the east and the land of Thomas Hillersdon, Esq. on the west, one other land lieth on the same furlong between ! the land of the said Thomas Hillersdon on both sides, and 3 roods residue of the said 4% acres lie in Mother feild upon Harborow bush way furlong between the land of the said F. 1 63 1 April 12. — Indenture made between Michael Dimocke of Cranfield gent, and Alice Stokes of Elstow spinster of the one part and Thomas Hillersdon of Elstow esq. and James Newman of Elstow gent, of the other part Witnesseth that the said M. D. and A. S. in consideration of the sum of ^20 sell to the said T. H. & J. N. a mes- suage or cottage and pightle of pasture ground thereto adjoining containing one acre situate in Elstow late in the occupation of widow Armes standing in the field near Piper's house between the ground of Arnold Spencer, esq. north and the ground of William Thody south abutting west upon the King's highway leading towards Bedford. Covenant of quiet assurance by the vendors in respect of themselves and of John Stokes deceased father of the said A. S., and of Joan Dimocke mother, and Elizabeth wife of the said M. Whereas John Bidkin late of Elstow shepherd my late husband deceased by his last will and testament made the 7th of October 1609 be- queathed unto me the messuage and tenement wherein I now dwell and 3 acres of arable land thereto belonging Now know ye that I the said A. B. for and in consideration of the entire love and affection which I have and bear unto my loving husband Thomas Bonyon of Elstow brazier for his better maintenance of living after my decease have granted unto Thomas Bonyon my said husband his heirs and assigns for ever after my decease the messuage or

1634 June 1. — To all christian people, &c. Whereas John Bidken of Elstow shepherd deceased did in his life time by deed dated 25 September 1618 grant unto Anne Bidkin his loving wife a messuage or tenement with 10 acre of arable land and one rood of meadow lying in Elstowe
Now know ye that we Thomas Bonyon of Elstowe petty chapman and Anne Bonyon my wife late wife of the said J. B. deceased in consideration of the sum of 2s. do by these presents for ever release and quit claim unto Nicholas Waddop of Elstowe matmaker all rights that we the said Thomas Bonyon and Anne my wife now have in one rood of meadow in the parish of Elstowe in a meadow called Quechffenne late belonging to Mr. Spencer, &c.

XLVI.
1637 November 13. — Indenture of lease made between Thomas Hewytt of Pishiobury, Sawbridgeworth, co. Herts, Esq. and Margaret his wife of the one part and William Thodie of Elvestoe yeoman of the other part Witnesseth that in consideration of the rent reserved the said T. & M. H. demise to the said W. T. a tenement, pastures, meadows, lands and " leayes " &c. more par- ticularly described in a schedule hereunto annexed, being in the parish of Elvestowe now in the tenure of the said W. T. to hold from Michaelmas last past for the term of 1 2 years at the yearly rent of ,£24 7s. 4^d. payable half- yearly. Penalty of ^5 for cutting down a timber tree and 40s. for an elm tree.

W. within the parish church entry of Elstowe, 30s. of which sum she owes unto her said son M. W. and 30s. more she gives unto him to be paid all out of the cottage in which she now dwells, sells unto the said J. W. her cottage in Elstowe next the ground of Mr. Ashwell of London on the south and the ground of the Lord of Elstowe on the north, next to the common highway leading to Bedford on the east and the ground of the said Mr. Ashwell on the west, &c, to be holden of the chief lord of the fee, &c.

of Elvestowe yeoman of the fourth part. Whereas a fine was levied at Westminster at Michaelmas 1650 between the said N. W. & F. S. complainants and the said G. F. & Elizabeth his wife and W. H. and Anne his wife defor- ciants of 8 acres of land in Elvestoe whereby the said complainants acknowledge the tenement to be the right of the said N. which they the said N. W. & Frances had of the gift of the said deforciants who remised and quit claimed to the said complainants Now this Indenture witnesseth that the said fine shall be deemed and declared as follows, viz : — all those 4 acres of land in Elvestowe now in the tenure of the said N. W. which he lately purchased of the said G. F. & Elizabeth by deed dated 4 December 1649 being parcel of the lands contained in the said fine shall be deemed to belong to the said N. W. his heirs and assigns for ever, and in regard to those 4 acres of land now in the tenure of the said F. S. now in his tenure which he late purchased of the said W. H. by indenture dated 10 April 1649 being the residue of the said lands comprised in the said fine shall belong to the said F. S. and his heirs for ever.

D. a parcel of ground containing about one acre abutting east on the street and west upon some land be- longing to the monastery of Elstowe called the four acres,

Condition — that if the within bound J. W. and W. J. or either of them shall pay to the said T. H. the sum of ,£206 on the 23 day of December next ensuing at the dwelling house of Robert Abbott, scrivener, in Cornhill London then this obligation shall be void.

W. had a lawful estate in said premises and the right to sell same to the said N. W.

ANCIENT INDICTMENTS, 1341-2.

The Record from which these indictments are taken is officially " King's Bench, Ancient Indictments, Beds, no. i," of the Record Office. This class of Records includes " the original Indictments found by the Grand Jury in the Court of King's Bench, all informations ex- hibited on the Crown Side of the Court, and also such Indictments, Presentments, and Convictions as were re- moved into the King's Bench by Certiorari or
Writ of Error." No. i may be an Indictment found by Grand Jury ; the rest appear to be the presentments of a joint session of the Hundred Courts of Willey and Stodden to the Justices in Eyre. — The second membrane of the roll is practically a duplicate of the third.
A hard matter in these lawless times was the due administration of justice. Although now more than a century since the day when Falk de Breaute imprisoned such as he could catch of the Justices who had fined him, still, as this Record bears witness, things had not grown much better. The first entry deals with men who con- spired to use the forms of law corruptly for their own ends. This had for some time past been a crying evil; in 25 Edward i (1299- 1300), a statute, known as ' Articuli super chartas,' shows that a special writ had been devised for such cases as conspiracy to put forward false information or to pack a panel.

Conspirators are those who bind themselves by oath covenant or other tie that each will support other, undertaking falsely and maliciously to indict or cause to indict or falsely to present or to maintain pleas [etc.]
The definition was agreed in Parliament, and a copy ordered to be sent to all Justices of Oyer and Terminer.
Even more open defiance of the law was shown. In the sixth entry, John, Baron of Wahull, party to a suit in the Court of the Justices in Eyre, presents himself at Bedford with a number of armed followers as a threat. In the seventh entry, the Earl of Norfolk, likewise party to a suit, is not content with a mere display of force, but actually compels the Deputy Sheriff to empanel a jury of his own choosing.

Marshal of England, Henry de Valoynes, chevalier, Robert Bustclere, chevalier, and William Kenewy, came to Bedeford with others unknown about the Feast of St. Hilary in the eleventh year of the reign of the present King [Jan. 13, 1338], where an Assise of Novel Disseisin was to be held between Isolde widow of William Inge chevalier, and the said Earl and others, before John de Shard[elowe] and his fellow Justices, with force and arms, and by threats compelled Walter Blancfrount the lieu- tenant of the Sheriff of Bedeford to empanel [a jury] in the aforesaid assise according to the will and disposition of the said Earl.

They say that William son of Thomas de Wylie burgled the house of John Heylot in Radewell, and did feloniouslv carrv off cloths of linen and of wool belonging to the said John to the value of 20s., about the Feast of St. Nicholas in the fourteenth year of the reign of the present King [6 Dec, 1340], and he is a common thief.

[Note. — A fairly complete set of the Lists of Persons qualified to serve on Juries in the County of Bedford, from 1780 onwards, is preserved among the County Muniments. Some of these Lists have been made available for publica- tion by the zealous labour of the Rev. J. E. Brown, and are printed here by permission of the Records Committee of the County Council.
The earlier lists consist of the original papers made out by the Parish Constable, among whose qualifications accurate spelling was not, as a rule, included, though his writing was generally quite good. The papers were generally made out the year before that by which the List is dated ; thus in the first transcript below the date of the papers (1780) is given, but the List is filed as that for 1781.
These papers have not been transcribed word for word ; the result would have been burdensome alike to write, to print, and to read. Every name, however, is given in the following transcripts ; the original spelling of place-names, sur-names, and occupations has been re- tained ; font-names, which in the originals are usually contracted into Geo., Jas., Jno., etc., have been expanded into modern form. Each List is generally signed by two Magistrates, but their names have been omitted below on the ground that they can easily be traced from other sources. The villages are printed in the order in which they occur on the files, and are often " alphabetically " arranged onlv as regards the initial letter. For anv particular village the Index should be consulted.

The qualifications for serving on a jury seem to be sufficiently well set out in the following extracts from lists of 1 78 1, which serve also to illustrate the literary capacity of some of the constables.
" September ye 9th : 1780 A trew List to the Best of My Knowlidge of all Persons in the parrish of Chal- grave in the County of Beddford that are Above the Age of One and twenty Years and Under the Age of Seventy vears that are Qualifyed to Serve one Juries upon tryalls as Followeth."
" By Vertive of a Warrant to me Derected I was Comanded to make a Lisst of ye Persons Qualified to Serve On ye Juriers by haveing 10 £ per year and Dwelling in Clifton " [1780].
" This is a Jest and true List of all the freeholders how are in aney Qualitycation to sarve upon a Jurey in the Parish of Salford " [1780].
The last entry raises a query which I have not yet been able to answer, namely, the exact relation between the numerous Jury Lists and the comparatively few Free- holders' Lists preserved among the County Muniments.
The qualification for the jurymen at the time of the earlier lists here printed seems to have been laid down by 4 and 5 William and Mary, cap. 24, § 15 ; but the last list, that of 1830, has a different basis. By 6 Geo. IV., cap. 50, it was enacted in 1825 " that every Man except as hereinafter excepted, between the Ages of Twenty-one Years and Sixty Years, residing in any County in Eng- land, who shall have in his own Name or in Trust for him, within the said County, Ten Pounds by the year above Reprizes in Lands or Tenements, whether of Freehold, Copyhold, or Customary Tenure, or of Ancient Demesne, or in Rents issuing out of any such Lands or Tenements, or in any such Lands, Tenements and Rents taken together, in Fee Simple, Fee Tail, or for the Life of himself or some other Person, or who shall have within the same County Twenty Pounds by the Year above Reprizes,

in Lands or Tenements, held by Lease or Leases for the absolute Term of Twenty-one Years, or some longer Term, or for any Term of Years determinable on any Life or Lives, or who being a Householder shall be rated or assessed to the Poor Rate, or to the Inhabited House Duty in the County of Middlesex, on a Value of not less than Thirty Pounds, or in any other County on a Value of not less than Twenty Pounds, or who shall occupy a House containing not less than Fifteen Windows " should be qualified and liable to serve on Juries.
Heralds and Genealogists, as a rule, confine their attention to families which have the right to bear arms, and neglect all of lower rank. The chief interest of these Lists, to my mind, is that they throw some light on the history of a class which is among the most worthy of respect in the community, which often has a length of land tenure and continuous descent not less remarkable than that of armigerous families, and from which most gentle and many noble families have sprung — the class of yeomen.
It is hoped that the publication of these Lists may serve to guide searchers to the parish where a particular yeoman name is to be found.
Further, these lists throw side-lights on the compara- tive prosperity of different villages ; as well as on the prevalence of the productive or creative trades, in contrast to the rarity of the mere distributive or retail trades, — a proportion which was reversed, to the great detriment of village life, in the first half of the nineteenth century.
The Lists cover the period of the " Enclosure " of most Bedfordshire villages, and it is instructive to note how the yeoman — a freeholder or copyholder — becomes replaced by the " farmer," holding only by a lease. Bedfordshire was always a Quaker county, and the special mention of Friends in these lists shows the centres of the Society ; presumably they were ineligible as Jurors owing to their refusal to take an oath. — Editor.]
